Terms of Sales.

PREAMBLE

Studio Gaïa, manufacturer of ceramic tile furniture, allows you to customize supports with the colors of tiles and joints. 

1. PRESENTATION AND FIELDS OF APPLICATION

Our general conditions of sale (hereinafter "General Conditions of Sale" or "CGV") are intended to govern relations between the company Studio Gaïa, registered with the RCS of Nanterre under number 905 000 410 00019 represented by Liza Mimouni, and its customer (hereinafter the "Customer"), under any commitment in connection with the supply of products (hereinafter the "Products") at the Customer's request.

Studio Gaïa and the Client are collectively referred to as the “Parties”.

The use of Studio Gaïa's services (the "Services") requires the unlimited acceptance of the conditions set out in the GCS.

When requested from the Customer on the website, the fact of not accepting the T&Cs by not checking the acceptance box is the expression of the Customer's refusal to use the products and services developed by Studio Gaïa. Therefore, in the absence of acceptance of the GCS the Customer could not access all of our services.

The T&Cs are a legally binding contract between the Client and Studio Gaïa. It provides the conditions that govern the use of the Services by the Customer. These GCS, as well as all their updates, additions, additional conditions and all the rules and policies of Studio Gaïa, together constitute the "Contract" between Studio Gaïa the Customer.

Studio Gaïa reserves the right to modify or amend the T&Cs at any time.

Use of the Services also requires acceptance of Studio Gaïa's Privacy and Personal Data Protection Policy accessible here.

 

2. GAÏA STUDIO PRODUCTS – ORDER – 

  1. Studio Gaia Products

    1. Studio Gaïa products are presented on our website at  https://www.studiogaiaparis.com/collection

    2. The selling prices of Studio Gaïa products are indicated in our catalog and expressed in euros, including VAT.

    3. Delivery costs are indicated during the payment process. These may vary depending on the size and weight of the package and the destination address.

  2. Order

Automatic recording systems are considered as proof of the nature, content and date of the order.

Studio Gaïa confirms the acceptance of its order to the customer at the email address that the latter will have communicated. The sale will only be concluded once the order has been confirmed.

Studio Gaïase reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order. The information given by the buyer, when taking the order, commits him: in the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility in which it could be to deliver the product.

3. TAILOR-MADE AND CUSTOM

  1. The Customer requests a quote on the Studio Gaïa website by completing the form provided for this purpose accompanied by a description of his project to allow the teams to provide a tailor-made response to the Customer's expectations.

  2. For the Customer's order to be validly taken into account, the Customer must return to Studio Gaïa the signed quote indicating that he has read and accepted the GCS (the "Order") or by clicking on "Accept" in the email containing his quote.

  3. This confirmation implies express and unreserved acceptance of the GCS, the designation of the products chosen, their quantities, colors, prices and delivery conditions.

  4. The Customer is committed to Studio Gaïa from the moment he confirms his Order.

  5. The acceptance of the Order by Studio Gaïa is formalized by an email sent to the Customer at the address provided when creating his personal account.

  6. The Order is considered finalized and is only prepared upon receipt of full payment from the Customer by Studio Gaia.

4. PAYMENT

  1. Payment for the Order is made by credit card, Paypal. Bank transfers are only accepted for Custom or Tailor-made orders

5. DELIVERY SERVICES AND DELIVERY TIMES

  1. The Order is not validated and the delivery times only begin to run upon receipt of full payment from the Customer by Studio Gaïa.

  2. Deliveries are made throughout France and Belgium by a transport service provider independent of Studio Gaïa.

  3. The Order for Studio Gaïa products is delivered to the address indicated by the Customer at the time of the Order within a maximum period of 8 to 9 weeks (excluding orders placed in July, August and December, periods affected by factory closures,   during which this period is extended to a maximum of 10 weeks) from receipt of full payment from the Customer depending on the finishes chosen by the Customer. 

  4. The delivery is made by our transport provider.

    1. Delivery will take place in the room of your choice if you live in Ile de France, and at the foot of the truck if you live outside Ile de France. 

  5. The Customer undertakes, upon receipt of the boxes and in the presence of the carrier, to check the condition of the packaging. As soon as possible, he undertakes to check that the Studio Gaïa products are intact and that there are no visible defects.

  6. In the event of damage observed related to transport on the box itself or the Studio Gaïa products, the Customer undertakes to note it on the carrier's delivery note.

  7. The Customer undertakes to send his complaints, in the event of a damaged, non-compliant or defective product, within 48 hours of receipt of the goods, with supporting photos, by sending an email to _cc781905-5cde-3194 -bb3b-136bad5cf58d_studiogaia.paris@gmail.com  If no complaint or reservation is made in this regard within this period, the products can no longer be returned or exchanged.

  8. Any damaged Studio Gaïa product will be replaced within 8 (eight) weeks.

 

6. WITHDRAWAL

  1. The Customer acknowledges that the Products are made at his request, on the basis of an individual order process in order to obtain personalized products.

  2. Given the personalized nature and particularly suited to Customer requests, Studio Gaïa does not accept returns of Products.

  3. Any 50% deposit will not be refunded

 

7. GENERAL PROVISIONS

1. Closure of the account at the initiative of the Client

The Client may, at any time, close his account.

 

2. Customer Representations and Warranties

The Customer declares to be able to conclude this Contract and that he is able to legally contract under French law.

  1. The Customer undertakes to make compliant use of the Services. 

  2. The Customer declares to have read, understood and accepted the T&Cs and undertakes to respect them.

3. Representations and Warranties of Studio Gaïa

Studio Gaïa is responsible vis-à-vis the Customer for its products until they arrive at the address indicated by the Customer.

  1. Studio Gaïa guarantees the Customer within the framework of the guarantee against hidden defects by replacing defective products, or parts rendering them unfit for their use.

  2. The guarantee offered by Studio Gaïa to Customers is limited to normal and compliant use of the Products for their intended purpose, in accordance with the description of the product sheets on the website.

  3. By way of illustration, Studio Gaïa does not guarantee the Products in the following situations:

  • in the event of a purchase error, breakage, defect or alteration occurring during or after the installation of the Products by the Customer or any third party,

  • in the event of a modification made to the Products by the Customer or any third party

  • in the event of alteration of the materials constituting the Product due to improper storage or maintenance or maintenance not in accordance with Studio Gaïa's recommendations,

  • in the event of overloading or any other improper use of the Products.

8. GENERAL.

  1. Before any legal action, the Client and Studio Gaïa will attempt to find an amicable solution to any dispute that may arise between them.

  2. The European online dispute resolution platform http://ec.europa.eu/consumers/odr/  provides information on alternative dispute resolution methods that may be of interest to the Customer. In the event of a dispute that cannot be resolved between Studio Gaïa and the Customer, the Customer may have recourse to this platform.

  3. The parties designate the exclusive jurisdiction of the courts located in Paris (France).

  4. These GCS constitute the entire agreement between Studio Gaïa and the Customer concerning the subject matter hereof.

  5. The current GCS can be consulted at any time on the Website at the following address:  https://www.studiogaiaparis.com/cgv

  6. If any provision of these T&Cs is held invalid or unenforceable, this provision will be deleted and the other provisions will remain applicable.

  7. The Client agrees that these T&Cs and all agreements incorporated therein may be automatically assigned or transferred by Studio Gaïa at its sole discretion. Section headings are for convenience only and do not define, limit, interpret or describe the scope or scope of their section.

  8. Any possible inaction by Studio Gaïa with regard to a breach on the part of the Customer or on the part of third parties does not mean that Studio Gaïa waives its right to act with regard to subsequent or similar breaches. All sections which by their context should survive this Agreement shall survive any termination or expiration of this Agreement.
